Personal Data We Process

Personal data is any information that can provide details about an identifiable natural person. Sylvan processes your personal data because you use our services and/or because you provide it to us directly.

Below is an overview of the types of personal data we may process on this website:

  • Other personal information you actively provide, for example, by creating a profile on this website, through correspondence, or over the phone
  • Location data
  • Information about your activities on our website

Purposes and Legal Bases

Sylvan processes your personal data for the following purposes:

  • To send our newsletter and other publications.
  • To be able to call or email you if necessary for our service delivery.
  • To inform you about (changes to) our services and products.
  • To offer you the opportunity to create an account.
  • To conclude and execute agreements.
  • For the development and improvement of our services.
  • To promote safety, security, health, and integrity.
  • Sylvan analyzes your behavior on the website to improve it and to tailor our product and service offerings to your preferences.
  • Sylvan also processes personal data if legally required, such as data needed for our tax returns.

The legal grounds for processing your personal data may include the necessity of such processing to conclude and execute our agreement with you, to fulfill a legal obligation, to protect your or another natural person’s vital interests, or for the legitimate interests of Sylvan or our partners, unless your interests, fundamental rights, or freedoms override them.

Automated Decision-Making

Sylvan may use automated tools to make decisions about individuals. However, decisions with negative outcomes for you will not solely be based on the results of such an automated tool. This exception does not apply if:
i. The use of automated tools is necessary for the performance of a legally required or prescribed task;
ii. The decision was made by Sylvan to enter, manage, or execute an agreement with you; or
iii. You have provided explicit consent.

These exceptions do not apply to the processing of sensitive personal data.

In cases referred to in points (ii) and (iii), Sylvan will take appropriate measures to protect your legitimate interests, such as giving you the opportunity to express your opinion.

Retention Periods

Sylvan retains your personal data only as long as necessary to achieve the purposes for which it was collected, to protect the legitimate interests of Sylvan, and as long as legally required. If we process your personal data to respond to a query from you, we will retain it for four weeks to handle follow-up questions or a possible complaint.

Sharing Personal Data with Third Parties

Sylvan shares your personal data with various third parties if necessary to execute the agreement and fulfill legal obligations. This may include banks, insurers, IT service providers, accountants, consultants, and subcontractors. We sign a processing agreement with companies processing your data on our behalf to ensure the same level of security and confidentiality. Sylvan remains responsible for these processes. Additionally, Sylvan shares your personal data with other third parties only with your explicit consent.

Sylvan uses functional and analytical cookies. A cookie is a small text file stored in the browser of your computer, tablet, or smartphone upon first visiting this website. Sylvan uses cookies for purely technical functionality, ensuring the website works properly and remembers your preferences. These cookies are also used to optimize the website.

Upon your first visit to our website, we informed you about these cookies and requested your consent to place them.

You can opt-out of cookies by setting your internet browser not to store them. Additionally, you can delete all previously saved information via your browser’s settings.

Access, Correct, or Delete Your Data

You have the right to access, correct, or delete your personal data. You also have the right to withdraw your consent for data processing or to object to the processing of your personal data by Sylvan. Additionally, you have the right to data portability, meaning you can request to have the personal data we hold transferred to you or to an organization of your choice. You can send a request for access, correction, deletion, or transfer of your personal data, or a request to withdraw your consent or object to data processing, to esther.nijskens@sylvan.nl.

To ensure the request is made by you, we may ask you to provide proof of identity. We will respond to your request as quickly as possible, but no later than four weeks. Deletion of your personal data is only possible if this data is no longer relevant.

Security

Sylvan takes the protection of your data seriously and takes appropriate technical, physical, and organizational measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized changes. This includes measures like IT security policies, employee training, and secure storage and connections.
